Logjam of Injustice

Our mission is
simple: we want our day in court for plaintiffs dying from
mesothelioma. Federal multi-district litigation docket 875 has
obstructed that end and requires reform. If the judicial panel
that oversees MDL 875 refuses to fix the problem after appeals
through the proper channels, then we welcome the intervention of
the US Senate to hold hearings and pass legislation that will

Superior Court Upholds
Loss of Consortium for Mesothelioma Victim
(5/18/07)
A recent California appellate
decision (Jonnie Lee Pounds v. Crane Co., May 2007) upheld the
loss of consortium claim for the wife of a mesothelioma victim
poisoned by asbestos. The corporate defendant, Crane Company,
argued that since the victim's exposure to their product ended
in 1959, and since the victim and his wife didn't get married
until 1985, the wife couldn't claim loss of consortium.

Fair Play for Navy Veterans

Just like they need medical care,
navy veterans need a level playing field in the courts.
Navy vets who pursue civil claims
are confronted by loopholes in the law that allow shrewd
asbestos defense lawyers to either harmfully delay the
prosecution of a claim (called “federal officer” removal to
federal court), or delay the claim altogether (called the” MDL
Black Hole”).

California Judge
Rejects Defense "Removal" Caper, Gives Navy Vet His Day in Court
A federal judge in California
recently ruled that General Electric must stand trial in
California state court for its failure to warn navy sailors
about asbestos contained in the products and equipment GE
installed on naval vessels. Seeking to avoid state court and try
the case in federal court, where asbestos lawsuits languish and
rarely see light of day, General Electric sought to use a
discredited legal argument to keep the case out of state court.
