Former Circuit Court Judge Explains Crisis in Asbestos Litigation
"It is difficult to conceive of any other compensation system that is more susceptible to abuse and less likely to arrive at accurate results." Former Fifth Circuit Court of Appeals Judge Griffin B. Bell introduces and explores the current crisis in asbestos litigation. A Kennedy judicial appointee and former president of the American College of Trial Lawyers, he cites problems with proof of disease and evidence of exposure as well as the overwhelming number of cases filed by plaintiffs with no disease. Judge Bell goes on to explain how the problem developed and how simple legal remedies can fix it.
